The Mumbai Administration has ordered to impose Section 144 under Indian Penal Code (IPC) for 15 days, starting from November 1st to November 15th 2022, under Section 37 of Maharashtra Police Act 1951.
The decision taken by the Mumbai Administration was regarding the aftermath of the ‘suspicious’ bomb threat call received by the Department from the unidentified caller on 19th October 2022.
Section 144 under Indian Penal Code states that, “Joining unlawful assembly armed with deadly weapon. —Whoever, being armed with any deadly weapon, or with anything which, used as a weapon of offence, is likely to cause death, is a member of an unlawful assembly, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both.”
Besides the restriction in gathering crowd of more than 5 people, the order issued also states that the civilians are prohibited from carrying any processions and burning fireworks. Also, using loud speakers and playing music loudly is restricted.
The Department has issued another order along with imposition of Section 144, under the Section 2(6), 10(2) &37(1) of Maharashtra Police Act 1951 which states that the Commissioner has outlawed the usage and transportation of any weapon within the city from 3rd November 2022 to 2nd December 2022.
The order also states that transporting, collecting and producing any substances, which cause injuries to the body if attacked by them. Also, displaying dummy sculptors and portraits of the corpses are prohibited.
The Department said that those found violating the laws will be strictly penalized.
